Welcome to tomohi! These Terms of Service (hereinafter referred to as 'Terms') constitute a legal agreement between you and HONG KONG GUIMAO TECHNOLOGY LIMITED (hereinafter referred to as 'the Company') regarding the use of the tomohi application and related services (hereinafter referred to as 'the Service'). By downloading, installing, registering, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to any part of these Terms, please do not use the Service.
tomohi is a comprehensive social platform for global users, offering the following core features:
· Social Networking: profile display, interest matching, feed posting and interaction
· Live Streaming: real-time audio/video broadcasting, live chat, virtual gift tipping
· Instant Messaging: text, voice, image, and video messages with end-to-end encryption
· Voice Chat Rooms: multi-person real-time voice chat rooms, mic management, and social interaction
The Company reserves the right to modify, suspend, or discontinue any or all features of the Service at any time without prior notice.
3.1 You must be at least 18 years old (or the legal age of majority in your jurisdiction) to register and use the Service.
3.2 You must provide true, accurate, and complete personal information during registration and keep it up to date.
3.3 You are responsible for safeguarding your account credentials (including password) and are fully responsible for all activities conducted through your account.
3.4 If you discover any unauthorized use of your account, please notify the Company immediately.
3.5 Each user may only register one account. Accounts may not be transferred, rented, lent, or otherwise shared without the Company's written consent.
When using the Service, you agree not to:
· Post or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
· Impersonate any person or misrepresent your affiliation with any individual or entity
· Send spam, advertisements, or unauthorized promotional content
· Collect, store, or share other users' personal information
· Use automated means (such as bots, crawlers) to access or manipulate the Service
· Interfere with or disrupt the normal operation of the Service, or attempt unauthorized access to the Company's systems
· Engage in any activity that may harm the legitimate interests of the Company, other users, or third parties
· Use the Service for money laundering, fraud, or any other illegal criminal activity
The Company reserves the right to remove content that violates the above provisions at its sole discretion, and to take measures including warnings, feature restrictions, suspension, or permanent account bans against violating users.
5.1 You retain all ownership rights to the content you post through the Service (including but not limited to text, images, audio, video, and live streaming content).
5.2 You grant the Company a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute your content within the scope of operating and promoting the Service.
5.3 You represent and warrant that you have the legal right to publish such content and that it does not infringe upon any third party's intellectual property or other legal rights.
5.4 The Company is not responsible for user-posted content but reserves the right to review and take action on content suspected of violating these Terms.
6.1 The Service may offer in-app purchases, including but not limited to virtual gifts, virtual currency, membership subscriptions, and other digital goods and services.
6.2 All virtual items are licensed for use only and do not represent any actual property rights. Virtual items may not be transferred, traded, or redeemed for cash outside the platform.
6.3 Unless otherwise required by law, all purchase transactions are final and non-refundable once completed.
6.4 Revenue sharing for virtual gift sending and receiving shall be governed by the Company's policies as published from time to time.
6.5 The Company reserves the right to adjust virtual item pricing and service content at any time.
7.1 Streamers must comply with all applicable laws and regulations when using the live streaming feature. The following content is prohibited:
· Pornographic, violent, terrifying, or other illegal content
· Content that infringes on others' privacy, likeness rights, or intellectual property
· Content that induces or is harmful to minors
· False information, misleading content, or unauthorized commercial promotion
7.2 The Company reserves the right to monitor and review live streaming content in real-time, and to immediately interrupt streams and take disciplinary action against accounts upon discovering violations.
7.3 Streamers bear all legal liability arising from their live streaming activities.
8.1 The Company values your privacy. For detailed information about the collection, use, storage, and protection of personal information, please refer to the Company's Privacy Policy.
8.2 By using the Service, you consent to the Company collecting and using your information as described in the Privacy Policy.
8.3 The Company employs industry-standard security measures to protect your personal information, including data encryption, access controls, and security audits.
9.1 All intellectual property contained in the Service (including but not limited to software, designs, trademarks, brand identities, interface layouts, algorithms, and technical solutions) is owned by or lawfully licensed to the Company.
9.2 Without prior written permission from the Company, you may not reproduce, modify, distribute, transmit, display, publish, or create derivative works from the Service in any manner.
9.3 You may not reverse engineer, decompile, or disassemble the Service.
10.1 You may deactivate your account at any time through the in-app settings or by contacting customer support.
10.2 The Company reserves the right to suspend or terminate your account without prior notice in the following circumstances:
· Violation of any provision of these Terms
· Fraudulent, illegal, or harmful behavior towards other users
· Extended inactivity of the account (over 12 months)
· Other circumstances the Company deems necessary
10.3 After account termination, you will no longer be able to access any data, virtual items, or content associated with that account. The Company shall not be liable for any losses resulting from account termination.
11.1 The Service is provided on an 'as is' and 'as available' basis. The Company makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
11.2 The Company does not guarantee that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
11.3 To the maximum extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from the use of or inability to use the Service, whether based on warranty, contract, tort, or any other legal theory.
11.4 The Company assumes no liability for interactions between users or any disputes arising therefrom.
12.1 These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China.
12.2 Any disputes arising from or in connection with these Terms or the Service shall be submitted to the courts of competent jurisdiction in the Hong Kong Special Administrative Region for adjudication.
13.1 The Company reserves the right to modify these Terms at any time. After modifications are made, we will notify you through in-app notifications, push messages, or email.
13.2 Modified Terms take effect from the date of publication. If you continue to use the Service after the Terms have been modified, you are deemed to have accepted the updated Terms.
13.3 If you do not agree to the modified Terms, you should immediately stop using the Service and deactivate your account.

In compliance with applicable laws, the Company deposits an amount equal to or greater than one-half of the unused balance of prepaid payment instruments as of each reference date (March 31 and September 30 of each year) as issuance security deposits. Users have the right to receive preferential repayment from these deposits in accordance with statutory procedures regarding claims related to prepaid payment instruments.
In the event that a user's prepaid payment instrument balance is used by an unauthorized third party, the Company will handle the matter as follows:
· Please contact us at contact@hkguimao.com or via in-app support, and we recommend filing a report with your local police.
· The Company will cooperate with law enforcement investigations.
· If law enforcement confirms unauthorized use by a third party in violation of applicable laws, the Company will, upon the user's request, restore data to the extent possible and restore prepaid payment instruments lost due to unauthorized use to their state prior to the unauthorized access.
